 People's Republic of China Monitoring Chemicals Regulations

(The People's Republic of China Order No. 190 is promulgated and implemented.)

Article 1 These Regulations are formulated in order to strengthen the management of monitoring chemicals, protect the personal safety of citizens and protect the environment.

Article 2 These Regulations must be observed in the production, operation and use of monitoring chemicals within the territory of the People's Republic of China.

Article 3 The term "monitoring chemicals" as used in these Regulations refers to the following types of chemicals:

The first category is a chemical that can be used as a chemical weapon;

The second category is a chemical that can be used as a precursor to the production of chemical weapons;

The third category of chemicals that can be used as the main raw material for the production of chemical weapons;

The fourth category is specific organic chemicals other than explosives and pure hydrocarbons.

The list of various types of monitoring chemicals in the preceding paragraph shall be submitted by the competent chemical industry department of the State Council and published after approval by the State Council.

Article 4 The competent chemical industry department of the State Council is responsible for the management of national monitoring chemicals. The competent chemical industry departments of the people's governments of provinces, autonomous regions and municipalities directly under the Central Government shall be responsible for the management of monitoring chemicals within their respective administrative regions.

Article 5 The production, operation or use of monitoring chemicals shall be reported to the competent chemical industry department of the State Council or the competent chemical industry department of the people's government of the province, autonomous region or municipality directly under the Central Government for the production, operation or use of monitoring chemicals in accordance with these Regulations and relevant state regulations. The data, data and purpose of use are subject to inspection and supervision by the competent chemical industry authorities.

Article 6 The State strictly controls the production of the first type of monitoring chemicals. If it is necessary to produce the first type of monitoring chemicals for scientific research, medical treatment, manufacturing of drugs or protective purposes, it shall be reported to the competent chemical industry department of the State Council for approval and produced in a small facility designated by the competent chemical industry department of the State Council.

It is strictly forbidden to produce the first type of monitoring chemicals in the facilities not designated by the competent chemical industry department of the State Council.

Article 7 The State implements a special licensing system for the production of specific organic chemicals containing phosphorus, sulfur and fluorine in the second and third types of monitoring chemicals and the fourth type of monitoring chemicals; any unit without special permission And individuals are not allowed to produce. The special licensing method shall be formulated by the competent department of the chemical industry of the State Council.

Article 8 Newly built, expanded or rebuilt facilities for the production of second- and third-class monitoring chemicals and specific organic chemicals containing phosphorus, sulfur and fluorine in the fourth type of monitoring chemicals shall be delivered to the local provinces and autonomous regions. The competent department of the chemical industry of the people's government of the municipality directly under the Central Government shall apply for the examination and approval of the competent chemical industry department of the people's government of the province, autonomous region or municipality directly under the Central Government, and report to the competent chemical industry department of the State Council for approval before starting construction; after completion of the project, the local provinces and autonomous regions shall The competent chemical industry department of the municipality directly under the Central Government shall pass the inspection and acceptance and report to the competent chemical industry department of the State Council for approval before it can be put into production.

Newly built, expanded or rebuilt facilities for the production of specific organic chemicals that do not contain phosphorus, sulfur or fluorine in the fourth type of monitoring chemicals shall be filed with the competent chemical industry authorities of the local provinces, autonomous regions and municipalities directly under the Central Government before the start of production.

Article 9 Monitoring chemicals shall be stored in a dedicated chemical warehouse and managed by a special person. The storage conditions for monitoring chemicals should comply with relevant national regulations.

Article 10 Units that store monitoring chemicals shall establish strict outbound and warehousing inspection systems and registration systems; when they are found to be lost or stolen, they shall immediately report to the local public security organs and the competent chemical industry supervisors of the local governments, provinces, autonomous regions and municipalities directly under the Central Government. Departments; the competent chemical industry departments of the people's governments of provinces, autonomous regions, and municipalities directly under the Central Government shall actively cooperate with public security organs to investigate and deal with them.

Article 11 The monitoring chemicals that have deteriorated or expired shall be disposed of in a timely manner. The treatment plan shall be implemented after being approved by the competent chemical industry department of the people's government of the province, autonomous region or municipality directly under the Central Government.

Article 12 Where the first type of monitoring chemicals is required for scientific research, medical treatment, manufacturing of drugs or protective purposes, the application shall be submitted to the competent chemical industry department of the State Council. After examination and approval by the competent chemical industry department of the State Council, the approval document shall be The production unit designated by the competent industrial authority shall sign the contract and submit a copy of the contract to the competent chemical industry department of the State Council for the record.

Article 13 Where it is necessary to use the second type of monitoring chemicals, the application shall be submitted to the competent chemical industry department of the people's government of the province, autonomous region or municipality directly under the Central Government. After examination and approval by the competent chemical industry department of the people's government of the province, autonomous region or municipality directly under the Central Government, the approval document shall be adopted. Sign the contract with the distribution unit designated by the competent chemical industry department of the State Council, and submit a copy of the contract to the competent chemical industry department of the local province, autonomous region or municipality directly under the Central Government for the record.

Article 14 The competent department of the chemical industry of the State Council, in conjunction with the department designated by the competent department of foreign economic relations and trade of the State Council (hereinafter referred to as the designated unit), may engage in the first type of monitoring chemicals and the second and third types of monitoring chemicals and their production techniques. Import and export business of special equipment.

Where it is necessary to import or export the first type of monitoring chemicals and the second and third types of monitoring chemicals, their production techniques and special equipment, they shall entrust the designated units to import or export. Except for the designated units, no unit or individual may engage in such import and export business.

Article 15 The State strictly controls the import and export of the first type of monitoring chemicals. The first type of monitoring chemicals may not be imported for scientific research, medical treatment, manufacturing of drugs or for protection purposes.

The designated unit that accepts the import of the first type of monitoring chemicals shall submit an application to the competent chemical industry department of the State Council and submit a description and certification of the final use of the product; after reviewing the opinions signed by the competent chemical industry department of the State Council, it shall be submitted to the State Council for examination and approval. The designated unit shall apply to the competent foreign economic and trade department of the State Council for an import license in accordance with the approval document of the State Council.

Article 16 The designated unit that accepts the import of the second and third types of monitoring chemicals, their production technology and special equipment shall submit an application to the competent chemical industry department of the State Council and submit the imported chemicals or production technology or The description and certification of the end use of the special equipment; after examination and approval by the competent chemical industry department of the State Council, the designated unit shall apply to the competent foreign economic and trade department of the State Council for an import license with the approval document of the competent chemical industry department of the State Council.

Article 17 The designated unit that accepts the export of the first type of monitoring chemicals shall submit an application to the competent chemical industry department of the State Council, and submit the imported chemicals issued by the government of the importing country or the government agency for scientific research and medical treatment only. , the manufacture of drugs or protective purposes and the non-re-export of the third country's guarantee; after the State Council's chemical industry authorities review and sign the opinions, report to the State Council for review and approval. The designated unit shall apply to the competent foreign economic and trade department of the State Council for an export license in accordance with the approval document of the State Council.

Article 18 The designated unit that accepts the export of the second and third types of monitoring chemicals, their production technology and special equipment shall submit an application to the competent chemical industry department of the State Council and submit it to the government of the importing country or the government entrusting agency. The imported chemicals, production technology and special equipment are not used for the production of chemical weapons and guarantees for non-re-exporting third countries; after examination and approval by the competent chemical industry department of the State Council, the designated units shall submit the foreign economic affairs of the State Council to the State Council on the approval documents of the competent chemical industry department of the State Council. The competent trade authority applies for an export license.

Article 19 The use of monitoring chemicals shall be consistent with the purpose of use declared; if it is necessary to change the purpose of use, it shall be reported to the original examination and approval authority for approval.

Article 20 Where the first and second types of monitoring chemicals are used, the quantity of such monitoring chemicals and the use of such monitoring chemicals shall be reported to the competent chemical industry authorities of the people's governments of the provinces, autonomous regions and municipalities directly under the Central Government in accordance with relevant state regulations. Monitor the amount of final product produced by the chemical.

Article 21 Anyone who violates the provisions of these Regulations and produces monitoring chemicals shall be ordered by the competent department of chemical industry of the people's government of the province, autonomous region or municipality directly under the Central Government to make corrections within a time limit; if they fail to make corrections within the time limit, they may be fined up to 200,000 yuan; if the circumstances are serious, The people's governments of provinces, autonomous regions, and municipalities directly under the Central Government may be ordered to suspend production for rectification.

Article 22 Anyone who violates the provisions of these Regulations and uses monitoring chemicals shall be ordered by the competent chemical industry department of the people's government of the province, autonomous region or municipality directly under the Central Government to make corrections within a time limit; if they fail to make corrections within the time limit, they may be fined not more than 50,000 yuan.

Article 23 Whoever violates the provisions of these Regulations and operates chemical monitoring chemicals shall be confiscated by the competent chemical industry department of the people's government of the province, autonomous region or municipality directly under the Central Government for the illegally operated monitoring chemicals and illegal gains, and may be doubled in violation of the legal business amount. Article 24 Anyone who violates the provisions of these Regulations, conceals or refuses to report the materials and data concerning the monitoring of chemicals, or obstructs or obstructs the competent chemical industry department from performing inspection and supervision duties in accordance with the provisions of these Regulations shall be the people's government of the province, autonomous region or municipality directly under the Central Government. The competent department of the chemical industry shall impose a fine of not more than 50,000 yuan.

Article 25 Anyone who violates the provisions of these Regulations and constitutes a violation of public security management shall be punished in accordance with the relevant provisions of the Regulations on the Administration and Punishment of Chinese and State Security Administration; if a crime is constituted, criminal responsibility shall be investigated according to law.

Article 26 Anyone who has engaged in the production, operation or use of monitoring chemicals prior to the implementation of these Regulations shall go through the relevant formalities in accordance with the provisions of these Regulations.

Article 27 These Regulations shall come into force as of the date of promulgation.
